Duke Energy and a group of stakeholders have reached an agreement that further protects existing customers from the costs of serving data centers and other large-load customers in North Carolina. The settlement, filed between Duke Energy Carolinas and Duke Energy Progress and the North Carolina Public Staff, also includes Amazon, Google, Meta, Microsoft, the Carolina Industrial Group for Fair Utility Rates and the U.S. Department of Defense. Under the terms, large-load customers must make nonrefundable upfront payments for grid facilities serving only them, such as a substation, and post upfront deposits and security guarantees for grid upgrades that serve all customers, such as transmission lines. New large-load customers, including new data centers, must also take service under a High Load Factor rate schedule. If approved by state regulators, the agreement would apply to all large-load customers of 50 megawatts or more with an 80% load factor that sign an electric service agreement in North Carolina after June 1, 2026, expanding on protections Duke Energy first required in 2024 for loads of 100 megawatts or more. The North Carolina Utilities Commission is expected to decide on the agreement by mid-November.
